1. Introduction
Molloy Business Development Group ("Molloy," "we," "our," or "us") operates the SalesMax Plus (SMP) platform and its associated Missed Opportunity Alert System. This Privacy Policy explains how we collect, use, store, and protect personal information in connection with the SalesMax Plus application and the A2P (Application-to-Person) SMS text message alert service delivered through that platform.
This policy applies to all users of the SalesMax Plus platform, including customer administrators, Alert Managers, and Alert Supervisors who receive text message alerts via the salesmaxplusv2.com portal.
By using SalesMax Plus or receiving alerts through the platform, you acknowledge the practices described in this Privacy Policy.
2. Who This Policy Applies To
This Privacy Policy applies to the following individuals:
- Customer Administrators: employees of SalesMax Plus customer organizations who manage user roles and system settings within the SMP platform.
- Alert Managers: employees assigned by a customer administrator to receive SMS text message alerts for a specific store or location.
- Alert Supervisors: employees assigned by a customer administrator to receive SMS text message alerts across all stores or locations within their organization.
References to "you" or "users" throughout this policy encompass all of the above roles.
3. Information We Collect
3.1 Account and Profile Information
When a user account is created within SalesMax Plus, we collect information necessary to operate the platform, which may include:
- Full name and Business email address.
- Mobile phone number (used for SMS alert delivery)
- Employer organization and store or location assignment
- User role within the SMP platform
3.2 Consent and Role Assignment Records
When a customer administrator assigns an employee to an Alert Manager or Alert Supervisor role, the system captures and logs a consent record. This record includes:
- The SMP user ID of the employee being assigned the role
- The role being assigned (Alert Manager or Alert Supervisor)
- Consent status (Opted In or Opted Out)
- The SMP user ID of the administrator making the assignment or removal
- A UTC timestamp of the assignment or removal action
This record reflects the current consent state for each user. Prior assignment history is not retained once a new assignment or removal action is logged.
3.3 SMS Alert Activity
In connection with the delivery of SMS text message alerts, we may collect or process:
- Mobile phone numbers to which alerts are sent
- Alert delivery timestamps
- Alert type and content (missed opportunity notifications)
- User interactions with salesmaxplusv2.com, including login events and alert review and resolution activity
3.4 Call and Alert Data
The SalesMax Plus platform processes call data to generate missed opportunity alerts. This may include:
- Date, time, and duration of calls
- Store or location associated with a call
- Caller identification information
- Call recordings, which are accessible to authorized Alert Managers and Supervisors through the Alert Management page for the purpose of reviewing missed opportunity events
- Language KPI analysis results that triggered an alert
3.5 Usage and Session Data
We may collect technical information related to your use of the platform, including session authentication state, browser type, and access timestamps, for the purposes of security, system functionality, and platform improvement.
4. How We Use Your Information
We use the information we collect for the following purposes:
- To deliver SMS text message alerts to users who have been assigned Alert Manager or Alert Supervisor roles and whose consent has been captured by their customer administrator.
- To authenticate users and route them to the appropriate areas of the salesmaxplusv2.com portal.
- To enable Alert Managers and Alert Supervisors to review, action, and resolve missed opportunity alerts within the Alert Management page.
- To maintain consent and opt-in/opt-out records in compliance with A2P 10DLC SMS regulations.
- To support customer administrators in managing role assignments, alert assignments, and service configuration.
- To generate reporting on alert volume, recovery activity, response times, and related metrics for Alert Supervisors.
- To maintain the security, integrity, and proper functioning of the SalesMax Plus platform.
5. SMS Consent and Opt-In / Opt-Out
5.1 How Consent is Collected
The SalesMax Plus SMS alert service uses an employee-driven, application-authenticated consent model. Enrollment is initiated by a customer administrator but requires the employee’s own explicit confirmation before any messages are sent.
When an administrator assigns an employee to an Alert Manager or Alert Supervisor role, the employee’s consent field is set to No and no messages are sent. The next time the employee logs into SalesMax Plus, they are presented with a consent popup describing the alert service, message frequency, and how to opt out. If the employee agrees, their consent status is updated to Yes and a consent record is created capturing their user ID, confirmation method (in-app), and a UTC timestamp. If the employee declines, no messages are ever sent.
Upon in-app confirmation, the system sends a single activation message: “Welcome to SalesMax Plus alerts. Reply START to activate alert delivery to this number. Msg & data rates may apply. Reply STOP at any time to opt out.” The employee’s START reply activates alert delivery. No alerts are sent until START is received
5.2 Opting Out
An enrolled user may opt out by any of the following methods:
- Replying STOP to any alert message. Carrier suppresses delivery immediately. SalesMax Plus is notified via webhook, sets consent to No, removes the alert role, logs the event, and emails the customer administrator.
- Having their alert role removed by a customer administrator.
All opt-out events are logged with the user ID, method, and UTC timestamp. For support: support@molloyllc.com.
5.3 Re-Enrollment After a STOP
A STOP reply removes the user’s alert role and resets consent. To receive alerts again, the full enrollment cycle must be completed: the administrator assigns the role, the employee confirms consent via the in-app popup, the system sends the activation message, and the employee replies START. Every enrollment is treated identically regardless of prior history.
5.4 SMS Keywords
The SalesMax Plus alert system supports the following standard SMS keywords:
- STOP — Reply STOP to any alert message to unsubscribe immediately. You will receive a one-time confirmation and no further alerts will be sent to your number. Your organization’s administrator and the SalesMax Plus support team will be notified.
- START — Used as part of the enrollment activation flow only. To resume alerts after a STOP, the full enrollment cycle must be completed through the application.
- HELP — Reply HELP to any alert message to receive assistance information. You will receive a response with support contact details: support@molloyllc.com | salesmaxplusv2.com.
These keyword responses are supported in compliance with A2P 10DLC carrier requirements and applicable CTIA messaging guidelines.
5.5 Message Frequency and Content
Message frequency varies based on missed sales opportunity events at the user’s assigned location or organization. Each alert message reads: "SalesMax Plus Alert: Missed Sales Opportunity. Type smpalerts.com in your browser to access the alert just received. To stop alerts reply STOP or contact your SalesMax Plus administrator. Msg & data rates may apply."
6. How We Share Your Information
Molloy Business Development Group does not sell personal information. We may share information in the following limited circumstances:
- Service Providers: We may engage third-party vendors who assist in operating the SalesMax Plus platform or delivering SMS messages, including telecommunications carriers and SMS gateway providers participating in the A2P 10DLC program. These parties are permitted to use information only as necessary to deliver services on our behalf.
- Customer Organizations: Information about your role, alert activity, and alert resolution outcomes is visible within the SalesMax Plus platform to other authorized users in your organization, including Alert Supervisors and customer administrators.
- Legal Compliance: We may disclose information if required to do so by law, legal process, or governmental authority, or if we believe disclosure is necessary to protect the rights, property, or safety of Molloy Business Development Group, our customers, or others
- Business Transfers: In the event of a merger, acquisition, or sale of all or a portion of our business, personal information may be transferred as part of that transaction.
7. Data Retention
We retain personal information for as long as necessary to fulfill the purposes described in this policy, to maintain accurate consent records as required for A2P compliance, and to meet applicable legal obligations.
Consent log records reflect the current state of each user’s enrollment status. Prior assignment history is not retained after a new assignment or removal event is logged.
Alert records, call data, and resolution outcomes are retained in accordance with our standard data retention practices and any applicable contractual obligations with customer organizations.
8. Data Security
Molloy Business Development Group implements technical and organizational measures designed to protect personal information against unauthorized access, disclosure, alteration, or destruction. These measures include authentication controls for the salesmaxplusv2.com portal, session management, and access restrictions based on user role.
No method of electronic transmission or storage is completely secure. While we strive to use commercially reasonable means to protect your information, we cannot guarantee absolute security.
9. Your Rights and Choices
Depending on your location, you may have certain rights with respect to your personal information, which may include the right to access, correct, or delete information we hold about you, or to request that we restrict or object to certain processing activities.

As noted in Section 5, enrollment in the SMS alert service is managed through your employer’s SalesMax Plus customer administrator. To opt out of text alerts, please contact your SalesMax Plus administrator directly or reply STOP at any time to the text message.
10. Children’s Privacy
The SalesMax Plus platform and alert service are intended solely for use by authorized business personnel in a professional capacity. We do not knowingly collect personal information from individuals under the age of 18. If we become aware that we have collected personal information from a minor, we will take steps to delete that information promptly.
11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, the SalesMax Plus platform, or applicable law. When we make material changes, we will update the Effective Date at the top of this document. Continued use of the SalesMax Plus platform following notice of changes constitutes acceptance of the updated policy.
